What is a reserved share?
A reserved (forced) share (saklı pay) is the minimum share of certain statutory heirs that cannot be taken away from them by a will or a gift. The heirs with reserved shares are descendants, parents and the surviving spouse. The rates are: for descendants, one half of the statutory share; for each parent, one quarter; for the spouse, the whole statutory share when inheriting alongside descendants or the parents' line, andthree quarters in other cases (Turkish Civil Code (TMK) art. 506). The reserved share of siblings was abolished in 2007.
The part outside the reserved shares is the freely disposable portion; the deceased may leave it to anyone. Wills and gifts exceeding it are reduced through a reduction lawsuit (tenkis davası) brought by the heir whose reserved share has been infringed. Dispositions upon death (wills) are reduced first; if that is not enough, lifetime dispositions are reduced, starting with the most recent gift (TMK art. 570).
Time limit: A reduction lawsuit must be filed within one year of learning that the reserved share has been infringed and, in any event, within ten years from the opening of the will (for wills) or from the date of death (for other dispositions) (TMK art. 571). For sham transfers (a sale on paper that is in fact a gift), instead of reduction, an action for cancellation of the land registry entry on the grounds of the deceased's collusive transaction (muris muvazaası) comes into play.
