How is an estate divided?
Under Turkish law, statutory heirs are determined by a system of lines of heirs (zümre). The deceased'sdescendants (children and, if they have died, grandchildren) inherit first. If there are no descendants, themother and father inherit, and if they have died, their own descendants (the siblings). If there are none of these either, the grandparents and their children inherit. If even a single heir exists in an earlier line, the later line cannot inherit.
The surviving spouse inherits alongside every line: one quarter alongside the children, one half alongside the parents' line, three quarters alongside the grandparents, and the whole estate if there are none of these. A divorced spouse cannot inherit; if death occurs while divorce proceedings are pending, the spouse's position as heir is subject to special rules (Turkish Civil Code (TMK) art. 181).
If there is a will, the shares may change; however, the reserved shares of children, parents and the spouse cannot be removed by a will. For the certificate of inheritance (veraset ilamı / mirasçılık belgesi), see the certificate of inheritance page.
