How is property divided on divorce?

Spouses who married after 1 January 2002 and did not conclude a marital property agreement are subject to the regime ofparticipation in acquired property (edinilmiş mallara katılma). Property acquired through work during the marriage, social security payments and income from personal property are acquired property. Property owned before the marriage, property acquired by inheritance or gift, personal belongings and claims for non-pecuniary damages arepersonal property and are not divided.

From the total acquired property of each spouse, the debts relating to that property are deducted, transfers made without consideration are added back and contributions made from personal property (compensation) are subtracted; the remaining amount is the residual value. Each spouse may claim one half of the other spouse's residual value; the mutual claims are set off against each other. Property is valued at its market value at the time of liquidation (the date closest to the judgment).

The marital property regime ends on the date the divorce lawsuit is filed (Turkish Civil Code (TMK) art. 225). A lawsuit for the participation claim is subject to a ten-year limitation period running from the date the divorce judgment becomes final. For property acquired before 2002, a contribution claim (katkı payı alacağı) is assessed separately.
