How is an inheritance renounced?

An inheritance can be renounced (mirasın reddi) within three months. For statutory heirs, the period runs from the date they learned of the death of the deceased; for heirs appointed by will, from the date they were officially notified of the will (Turkish Civil Code (TMK) art. 606). The renunciation is made by an oral or written declaration to thecivil court of peace (sulh hukuk mahkemesi), must be unconditional and without reservation, and is entered in the register of the civil court of peace of the place where the succession opened (the deceased's last domicile) (TMK art. 609).

An heir who, within the period, takes possession of the estate, handles estate matters beyond ordinary administration, or conceals or appropriates estate assets loses the right to renounce (TMK art. 610). Where there are important reasons, the judge of the civil court of peace may extend the period (TMK art. 615).

If, at the date of death, the deceased's insolvency was evident or had been officially established, the inheritance is deemed to have been renounced (deemed renunciation, TMK art. 605(2)). In that case, without being bound by the three-month period, a declaration that the inheritance is deemed renounced can be sought against a creditor's enforcement proceedings.
