How is overtime pay calculated?
Weekly working time is at most 45 hours (Labour Code (İş K.) art. 63). Every hour above this is overtime (fazla mesai) and is paid at the normal hourly rate plus fifty per cent (art. 41). The hourly rate is the monthly gross wage divided by 225.
An employee who works six days a week without a rest day is paid fifty per cent more than the daily wage for each weekly rest day worked; for each day worked on a national or public holiday, an additional day’s wage is paid (art. 47).
The burden of proving overtime is on the employee. Where the case relies on witness testimony rather than workplace records, courts usually apply an equitable reduction of thirty per cent. Overtime claims are subject to a five-year limitation period.
