How is the mediation fee determined?
If the parties settle and the dispute concerns money, the fee is calculated in brackets on the settlement amount. In a settlement the fee may not be less than TRY 9,000.00, or TRY 13,000.00 in commercial disputes and partition of co-owned property. If no settlement is reached, or the dispute cannot be measured in money, the fee is calculatedby the hour.
If no settlement is reached in mandatory mediation (arabuluculuk), the fee for the first two hours is paid from the Ministry of Justice budget. If the meetings last longer than two hours, the parties pay the excess in equal shares, and it is added to the litigation costs in any lawsuit filed later (Mediation in Civil Disputes Law (HUAK) art. 18/A(13)).
