Who ultimately bears enforcement fees?
When starting enforcement proceedings (icra takibi), the creditor pays the application fee (TRY 732.00) and, in proceedings without a judgment, an advance fee of 0.5% of the claim (Fees Law (HarçK) art. 29). The advance fee is deducted from the collection fee charged at the end of the proceedings. If the debtor objects in proceedings without a judgment and the creditor has to go to court, the advance fee is refunded or credited against the court fee.
The collection fee depends on the stage at which the money is collected: 4.55% if paid after the payment order and before attachment; 9.10% if paid after attachment and before sale; 11.38% where collected through a sale. The collection fee is recovered from the debtor as part of the enforcement costs.
The prison fee is 2% of the money collected and cannot be charged to the debtor; it is deducted from the amount paid to the creditor (Law on Fees for the Construction of Prisons and Court Buildings art. 1).
