Rent and expropriation

Expropriation deadlines

Enter the date of the expropriation notification or public announcement; the tool calculates the last days for an annulment action, an action to correct material errors, a request to expropriate the remaining part and the right of repurchase.

Select the time limit and the date, then calculate.

Time limits not to be missed in expropriation

The administration applies to the civil court of first instance (asliye hukuk mahkemesi) for determination of the compensation and registration; the court sends a summons to the owner or makes a public announcement (Expropriation Law (KamK) art. 10).Within thirty days of this service, an annulment action against the expropriation can be filed before the administrative court, and a correction action against material errors before the civil courts (art. 14). If the filing of an annulment action is not documented within the time limit, the expropriation becomes final and only the amount of compensation can be disputed.

The owner must submit all defences and evidence concerning the value to the court within ten days of service. If the remaining part becomes unusable, the owner may request, within thirty days of service of the expropriation decision, that the whole property be expropriated, provided no action has been filed before the administrative courts (art. 12(5)).

If no step serving the purpose of the expropriation is taken within five years of the compensation becoming final, the owner may repurchase the property by repaying the compensation received, with interest; this right must be exercised within one year of arising (art. 23). Once you have found the time limits with this tool, you can also check the effect of the judicial recess with the deadline calculator.
