Eviction after two justified notices

In leases of one year or longer, if the tenant has caused two justified written notices to be served on them for non-payment of rent within the same lease year, the landlord may file an eviction lawsuit within one month from the end of that lease year (TBK art. 352(2)). In contracts shorter than one year, both notices must fall within the lease term and the lawsuit must be filed within one month from the end of the term.

For a notice to be justified, the rent must have been due and unpaid on the date of the notice. Payment by the tenant after the notice does not make the notice unjustified. Notices may be served through a notary, by registered letter with return receipt, or by any other written means that can be proven.

If the landlord notifies the tenant in writing, within the time limit for filing, that a lawsuit will be filed, the time limit is extended by one lease year (TBK art. 353). Applying to a mediator before filing is mandatory; strict (preclusive) time limits do not run during mediation (Mediation in Civil Disputes Law (HUAK) art. 18/A).
