Current debt in an enforcement file
Enter the amounts in the request for enforcement and any partial payments; the tool shows the current balance of the enforcement file with interest accrued after the proceedings began, and how each payment was allocated.
Enter the details of the proceedings and press “Calculate”.
How are partial payments allocated?
A debtor cannot require a partial payment to be deducted from the principal first. A payment is applied first to costs and interest, and the remainder to the principal (Turkish Code of Obligations (TBK) art. 100). This tool allocates payments in that order: to enforcement costs and the attorney fee, then to interest, then to the principal.
After enforcement proceedings (icra takibi) begin, interest runs only on the principal; no interest is charged on accrued interest or on costs (Law on Statutory and Default Interest (Interest Law) art. 3). As the principal decreases, so does the interest accruing on it.
The enforcement office’s closing statement of the file also includes the collection fee(4.55% if paid before attachment) and costs that arise later, such as service of documents. Ask the enforcement office for a statement of the file for the exact amount.
