Attorney fees (court-awarded)

How is it calculated?

In matters whose subject is money or can be measured in money, the attorney fee (vekâlet ücreti) is calculatedprogressively according to the brackets in Part Three of the tariff: each bracket has its own rate and the results are added together. The resulting fee may not be lower than the fixed fee set for the court hearing the case, nor higher than the amount awarded or dismissed (Tariff art. 13).

In enforcement proceedings, if the amount claimed is TRY 56,250.00 or less, the fixed fee (TRY 9,000.00) applies; this fee may not exceed the principal claim. If the debtor pays within the payment period, three quarters of the fee is awarded (Tariff art. 11). If a settlement is reached in mandatory mediation, the fee is the proportional fee plus one quarter (Tariff art. 16).

A lawyer and client may not agree on a fee below this tariff (Tariff art. 1(3)). The fee the court orders the opposing party to pay may be neither less than the tariff amount nor more than three times it (Tariff art. 3). Which tariff applies depends on the date of the judgment or the date on which the legal service was completed (Tariff art. 21).
